I tried to install ATI 12.6 driver on fresh 12.10 Ubuntu but installer could not configure 3.5 kernel.

I have no problems with installing ATI 12.6 driver on 12.04.1 Ubuntu so I'm curious if update-manager -d thing will keep fglrx driver present in my current 12.04 installation or I will have to wait for kernel hacks from someone?

Newer AMD drivers will support newer kernels, yes. However newer AMD drivers don't support anything less than HD5xxx series, so you will to have to a)Stay with the LTS or b)Use the open source driver. – Uri Herrera Oct 15 '12 at 16:51
